HVAC contractor requirements in Pennsylvania.

No state agency licenses HVAC contractors. HICPA's definition of home improvement expressly includes the installation of central heating and air conditioning 'without regard to affixation', so residential HVAC contractors must register with the Attorney General unless under the $5,000-per-year threshold. Technicians who service equipment that can release ozone-depleting refrigerants need federal EPA Section 608 certification.

Pittsburgh requires a Mechanical/HVAC Trade License to install, alter or replace any mechanical system in the city — ICC master mechanical exam, four years of experience and education, 8 CEUs a year, $90 a year. Philadelphia licenses sheet metal technicians for HVAC ductwork ($189 every three years, after a registered 8,000-hour apprenticeship) and requires its general Contractor License for HVAC businesses not otherwise licensed.

Home improvement fraud

Misleading inducements, taking an advance payment and not performing or refunding, concealing identity, posing as a government or utility employee, and similar acts are home improvement fraud. Amounts over $2,000 are a third-degree felony; the grade rises one step when the victim is 60 or older, and a second offense is a second-degree felony regardless of amount. The court may revoke or suspend the registration.

Unregistered work and other prohibited acts

Failing to register, abandoning a job without justification, or deviating from specifications without a signed change order is a prohibited act — and any HICPA violation is a violation of the Unfair Trade Practices and Consumer Protection Law, which carries Commonwealth civil penalties for willful violations and private suits for actual damages or $100, with up to treble damages.

No. Pennsylvania licenses no general, roofing, electrical, plumbing or HVAC contractors at the state level. The statewide requirement for residential work is Home Improvement Contractor registration with the Attorney General — a $100 two-year registration with $50,000 / $50,000 insurance minimums, not a skills exam.

A person whose home improvements totaled less than $5,000 in the previous taxable year, and home improvement retailers with net worth over $50 million (their installers must still register). The Act also does not cover new home construction or the conversion of commercial structures into residences.
