Landscaping contractor requirements in Arizona.

A.R.S. § 32-1121(A)(16) removes from the entire contractor chapter any person who functions as a gardener by performing lawn, garden, shrub and tree maintenance. That is a genuine, unconditional carve-out: mowing, pruning and planting crews are outside the Registrar's jurisdiction no matter what they charge. The moment the crew builds something, the exemption stops.

Construction landscaping is CR-21 Hardscaping and Irrigation Systems — renamed from Landscaping and Irrigation Systems by rulemaking effective November 5, 2017. Its scope includes non-loadbearing concrete, uncovered patios and walkways in brick, stone, pavers or gravel, wooden decks no higher than 29 inches, decorative garden walls and fences to six feet, retaining walls to three feet, low voltage landscape lighting, water features and irrigation systems including backflow prevention devices. It expressly excludes new electrical service panels, gas or plumbing lines, concrete driveways, pool deck coatings, load bearing walls and perimeter fencing. Herbicide use is governed separately by the Office of Pest Management under A.R.S. § 3-3613.

Unlike the $1,000 casual-or-minor exemption, A.R.S. § 32-1121(A)(16) simply removes gardeners from the chapter. The limit is the activity, not the price.

Spraying has hard ceilings

The landscaper herbicide exemption fails if you use restricted-use or danger-labeled products, sterilants or preemergents, operate as a primary weed management service, exceed five gallons of mixed herbicide or 25 pounds of nonliquid herbicide per day at a location, treat schools or childcare facilities, or apply without performing maintenance at the same time.

Q01Do landscapers need a license in Arizona?+
Not for gardening. A.R.S. § 32-1121(A)(16) exempts any person who functions as a gardener by performing lawn, garden, shrub and tree maintenance, with no dollar cap. A license is needed once the work becomes construction — hardscape, walls, decks, water features or irrigation systems — which is the CR-21 classification.
Q02Can my crew spray weeds without a pesticide license?+
Within narrow limits. A.R.S. § 3-3613 lets an unlicensed maintenance crew apply herbicide for weed management, but not restricted-use or danger-labeled products, sterilants or preemergents, not as a primary weed management service, not more than five gallons of mixed herbicide or 25 pounds of nonliquid herbicide per day at a location, not at schools or childcare facilities, and only alongside maintenance work. Customer records must be given and kept six months.
Q03Can a CR-21 contractor pour my concrete driveway?+
No. CR-21 may build uncovered driveways in brick, stone, pavers or gravel and place non-loadbearing concrete, but the classification expressly excludes concrete driveways, pool deck coatings and load bearing walls. Those need the concrete classification.
Q04What happens if an unlicensed landscaper sprays beyond the exemption?+
A first violation of the record-keeping rules draws a written correction notice, with civil penalties from a minimum of $50 on a second violation up to $1,000 for a third or later one. Applying herbicide beyond the exemption without licensure carries penalties of up to $1,000 to $2,000 under A.R.S. § 3-3613.
