W. Va. Code § 19-16A-7 bars anyone from applying pesticides for hire without a pesticide application business license from the Commissioner of Agriculture, issued only after an owner, manager, partner, or corporate officer passes an exam on state and federal pesticide law and safe use and storage. Everyone applying pesticides for the business — restricted-use or not — must be a certified commercial applicator in the right category or a registered technician under a certified applicator's direct supervision (§ 19-16A-7(e)). The business must file financial security (§ 19-16A-8); WVDA lists $300,000 bodily injury and $100,000 property damage liability plus workers' compensation.
WVDA fees are $60 a year for the Licensed Pesticide Application Business, $20 a year for a commercial applicator, $20 a year for a registered technician, and $20 for the applicator exam. Licenses expire at the end of the calendar year; renewals after January 15 carry a 25% penalty, after February 1 a 50% penalty, and anyone not renewed by April 1 must retest (§ 19-16A-13). Commercial applicators need 20 continuing certification units in every category every three years. Pest control operators are excluded from contractor licensing unless they also do structural repairs over $1,000 on treated property (§ 30-42-3(d)(4)).
The state sets the license floor; the county or city permit office controls filing, inspections, and local rules wherever the job site sits.
Pesticide business and applicator licensing is issued only by the WV Department of Agriculture. Licensed pest control operators fall outside the Contractor Licensing Act unless they do structural repairs over $1,000 (§ 30-42-3(d)(4)), so ordinary treatment work needs no building permit-related contractor license; any repair work over that line triggers the Contractor Licensing Board layer and local permits.
