The construction side is straightforward. C-27 Landscaping covers constructing, maintaining, repairing and installing landscape systems and facilities, and preparing and grading plots for architectural, horticultural and decorative treatment. Anything at $1,000 or more, or anything needing a permit, needs the classification. Tree work is its own classification now — C-49 Tree and Palm replaced the old D-49 subcategory — with a narrow carve-out for a gardener's incidental pruning of trees under 15 feet.
The side that catches people is pesticides. Under the Food and Agricultural Code a maintenance gardener who occasionally does pest control in support of the gardening business needs a Maintenance Gardener Pest Control Business licence ($180 new, $360 renewal), with a qualified person at every business location holding a Qualified Applicator Certificate in subcategory Q or category B. On top of that, FAC § 11732 makes it unlawful to advertise, solicit or operate as a pest control business in any county without registering with that county's agricultural commissioner for the current calendar year.
The state sets the license floor; the county or city permit office controls filing, inspections, and local rules wherever the job site sits.
Two layers of local government matter here, and they do different jobs. The city or county building department issues permits for hardscape, drainage and structural landscape work and collects the B&P § 7031.5 licence statement. Separately, the county agricultural commissioner — a county officer enforcing state pesticide law — takes the annual pest control business registration under FAC § 11732 and inspects use reporting. Cities also levy business tax certificates.

DPR's own requirements say persons doing pest control incidental to new construction are not required to obtain the maintenance gardener business licence — and that expressly includes construction work establishing new landscapes.
The Maintenance Gardener licence is for occasional pest control in support of a gardening business. If the primary purpose of the business is pest control, DPR requires the full Pest Control Business licence — $360 new and $720 at renewal, plus $180 per branch.
A QAC applicant in subcategory Q takes only the Q exam, which has laws and regulations built in, and carries a lighter CE load — 8 hours per two-year cycle with 2 in laws, against 20 hours with 4 in laws for a general QAC or QAL.
